In 2015, the U.S. Supreme Court dealt lender’s efforts a severe blow when it held that the notice of rescission could be issued at any time within three years after the loan closed, not file suit to rescind within three years, as the industry had argued (Jesinoski v. Countrywide Home Loans, Inc.,135 S. Ct. 790 (2015). Just recently on December 6, 2018, the Ninth Circuit issued an opinion that further weakened the lenders’ position (Hoang v. Bank of America, N.A., __ F.3d __, Case No. 17-35993, 2018 WL 6367268 (9th Cir. 2018)). Specifically, the Ninth Circuit expanded the time for a borrower to sue to enforce rescission of a loan if a lender fails to wind up the loan after a notice of rescission.Under the Truth in Lending Action (TILA), borrowers have the right to rescind certain loans within three business days after consummation of the loan. 15 U.S.C. § 1635(a). However, if the lender fails to make the required disclosures under TILA, the deadline for borrowers to rescind the loan expands to three years from the consummation of the loan. 15 U.S.C. § 1635(f). In its’ 2015 Jesinoski decision the Supreme Court held that under TILA, a borrower only has to notify a lender of his or her intent to rescind within three years.  The borrower is not required to bring suit within the three years to effectuate the rescission. A simple notice is all that is required. The Supreme Court explained, “so long as the borrower notifies within three years after the transaction is consummated, his rescission is timely. The statute does not also require him to sue within three years.” Jesinoski, 135 S. Ct. at 792.Under TILA, if a borrower provides notice within the three years, a creditor must take steps to “wind up”  the loan within 20 days of the notice. 15 U.S.C. § 1635(b). However, as is often the case, what if the lender fails to act to wind up the loan as required by TILA?  In Hoang v. Bank of America, N.A., __ F.3d __, Case No. 17-35993, 2018 WL 6367268 (9th Cir. 2018), the Ninth Circuit answered the following question: “when a borrower effectively rescinds a loan under TILA, but no steps are taken to wind up the loan, when must suit be brought to enforce that rescission?” Id. at *3.In Hoang, the district court ruled that a claim to enforce rescission is governed by the one-year statute of limitations for TILA damages claim. On appeal, the Ninth Circuit rejected the district court’s application of the one-year statute of limitations that applies to TILA damage claims.  The Ninth Circuit reasoned, “TILA provides for both legal damages and equitable relief but only includes a statute of limitations for legal damages relief. The statute does not suggest that the statute of limitations for legal damages relief is also applicable to claims for equitable remedies. If Congress intended that statute to apply, Congress surely knew how to draft the statute accordingly.” Id. at *4.Because TILA does not provide a statute of limitations for rescission enforcement claims, case law requires federal courts to borrow a limitations period from analogous state law. In Hoang, the Ninth Circuit looked to its host state, Washington, as a guide. The Ninth Circuit ultimately used Washington’s six-year statute of limitations for contract actions. The Court reasoned, under Washington’s general contract law, the statute of limitations sets forth a six-year limitation period for an “action upon a contract in writing, or liability express or implied arising out of a written agreement.” The loan agreement between Hoang and the Bank is a contract in writing. An action to rescind that loan (under TILA or otherwise) arises out of that written agreement. Because TILA rescissions necessarily require a contract to be rescinded, contract law provides the best analogy and we adopt the general contract law statute of limitations.Id. at *4 (citation omitted). In summary, the Ninth Circuit concluded that “[a]pplication of Washington’s longer six-year contract statute of limitations would actually further TILA’s purpose, which is to protect consumers from predatory lending practices and promote the informed use of credit.” Id.Therefore, under Jesinoski and Hoang, a borrower has up to three years to provide notice of rescission of the loan. If the lender fails to wind up the loan, the borrower has another six years to bring an action to enforce the rescission. Thus, a borrower can have to up nine years from consummation of the loan to enforce rescission under TILA. Although this is a decision by the Ninth Circuit, which applied Washington state law, borrowers will certainly rely on Hoang and argue that the Ninth Circuit’s reasoning should apply to their specific case. The statute of limitations to enforce a rescission claim may be shorter or longer than six years depending on the breach of contract statute of limitations for each specific state.There are several take-away from the decisions in Jesinoski and Hoang. First, a lender/servicer should quickly and carefully review any notice of rescission or even an indication of rescission from the borrower.  Second, if a borrower properly rescinds the loan under TILA, the lender/servicer has 20 days to “wind up” the loan. Third, if there is a question about whether the lender provided the required TILA disclosures or if the borrower timely and properly gave notice of his or her intent to rescind, the lender should consider immediately filing a declaratory relief action to resolve those disputes at that time instead of waiting years for the borrower to file an action to enforce the rescission. CLICK HERE TO BOOK YOUR PLACE NOW!Each year, to celebrate the festive season, I have a special workout that I do with my members.  I have been doing this for the last 3 years and it hasn’t failed to disappoint yet. The workout is simple and effective, and by effective I basically mean that it is a bit horrible. As it is Christmas, the workout has a Christmassy theme. If you know the 12 days of Christmas, (and let’s face it, who doesn’t?), that is the inspiration for the workout.  So, take a minute and have a little sing song to yourself.  Get that catchy tune into your head. Maybe get Sandra from the office to join in and help you.  Can Sandra sing?Oh, well maybe not then. The best part of this workout is that you don’t need much space, or any equipment, but if you have access to some and want to make it harder, you can add some in. Want to give it a try?Here we go. The workout goes like the song does (12 days of Christmas)All you need is an exercise mat. 30 seconds jogging on the spot2 More Burpees3 Squat Jumps4 Forward lunge – (each leg) (add weight if needed)5 prisoner squats (add weight if needed)6 reverse lunges – lunging (each leg) (add weight if needed)7 X-body Mountain Climbers – climbing (each leg)8 Plank to Press – pressing9 Push ups – pushing10 Total Body Extensions – extending11 Jumping Jacks – jumping12 Burpees – burpingHow you do the workout is exactly like the song. Do the 1st exercise;“On the first day of Christmas, Rushe Fitness gave to me: 30 seconds jogging on the spot” Then do the 2nd exercise, then the 1st exercise.“On the second day of Christmas, Rushe Fitness gave to me: 2 more burpees and 30 seconds jogging on the spot.” Then do the 3rd exercise, then the 2nd, then the 1st.“On the 3rd day of Christmas, Rushe Fitness gave to me: 3 Squat Jumps, 2 more burpees and 30 seconds jogging on the spot.”  Then 4th, 3rd, 2nd, 1st and so on until you are going from 12 all the way down to 1. “On the 4th day of Christmas, Rushe Fitness gave to me: 4 Lunges lunging, 3 squat jumps jumping, 2 more burpees and 30 seconds jogging on the spot.”You continue to work your way through the workout exactly like the sequence of the song. It sounds easy on paper, trust me, it’s not. The exercises suggested are to allow minimal equipment to be used. If you are in a training facility and have access to a load of equipment, feel free to add in different exercises to make it harder or easier or to suit your style of training.You are only limited by your imagination. ☺If you try it out, I’d love to hear how you get on with it.  Send me a message on my Rushe Fitness page through the link below and let me know how you get on with it. Santa hats and Christmas jumpers are optional. #Lean 2.0My New Lean 2.0 Challenge kicks off January 6th. CWG: Shuttler Kashyap, Jwala-Ashwini in finals; Sindhu, Guru win bronze

first_imgJwala Gutta (left) and Ashwini Ponnappa in this file photo.P Kashyap stood just a win away from a historic gold while P V Sindhu and RMV Gurusaidutt managed a bronze each in the badminton competition of the 20th Commonwealth Games on Saturday.Delhi Games gold medallist pair of Jwala Gutta and Ashwini Ponnappa too were on course to defend their women’s doubles title after winning their last-four match at the Emirates Arena.World No. 22 Kashyap played out of his skin to avenge his loss to England’s Rajiv Ouseph, who had beaten him at the 2010 Delhi Games and also dumped him during the mixed team event at the Emirates Arena here.In an energy-sapping one hour and 23 minute match, Kashyap bounced back from a game down to edge out World No. 26 Ouseph 18-21 21-17 21-18 and assure himself of at least a silver medal.World Championship bronze winners Jwala and Ashwini notched up an easy 21-7 21-12 win over Lai Pei Jing and Loo Yin Lim. She lost a lot of points at the nets to allow a tired Jing to claw back every time Sindhu moved ahead.At the first break, Sindhu managed to lead 11-10 but the Malaysian was always breathing down her neck as they moved to 17-16 when Sindhu faltered with a forehand net shot and then hit long twice to hand over the lead to Jing.However, Sindhu didn’t give up and managed to wrest back control and eventually pocketed the first game when Jing hit wide.After a pep talk from coach Pullela Gopichand, Sindhu found her bearings and the second game turned out to be a cakewalk as Jing struggled to move around the court, while the Indian dominated with her array of strokes.The highlight of the day for India was Kashyap’s gritty performance against European Championships silver medallist Ouseph, which conjured up hopes of seeing an Indian male shuttler winning a gold for the first time in 32 years.Prakash Padukone had won the men’s singles gold medal at the 1978 Commonwealth Games in Edmonton, Canada, which India retained through Syed Modi four years later.It was a battle of attrition between Kashyap, 27, and Ouseph as both the shuttlers engaged themselves in long rallies, with the longest going on for 72 minutes in the decider, which had a total of 71 strokes.Kashyap was up 11-8 but he could not stop Ouseph to run away with the first game. However, he made sure to play long rallies and didn’t allow Ouseph to score points at the forecourt which is his strength and he led both in the second and third game.After the match, Kashyap said: “He is a very tricky player and we have played against each other earlier. He is one player who can take four-five points on a stretch. He keeps on coming and retrieving the shuttle.”My tactic was to keep him engaged in a long rally and see if he commits mistakes. It was about who cracks under pressure first. I could not keep him on long rallies in the first game but was able to do it in the second and third. In the third game, I was well ahead towards end but he won a few straight points and came close. But somehow, I am happy that I won,” he said.advertisementAfter her win in the bronze medal match, Sindhu was asked about her semifinal loss.”It was anyone’s game. I can’t explain it because I was very disappointed. I was very disappointed not to be in the final but I’ll just have to be happy with this bronze medal.””At least I have a bronze but that is not the medal I wanted. I came here for a gold and everyone in India hoped I would win a gold but I will definitely do that in four years’ time (at the Gold Coast 2018 Commonwealth Games).”On making a comeback after the reverse in the last-four clash, she said, “My coach told me not to think about it. Ups and downs happen in life. You just have to move on but it was on my mind before the game and it’s still on my mind now.”My coach said to me that I just had to come back. MAN Engines to Power Global Class Cruise Ship Duo

first_imgzoom MV Werften, a group of three of the largest shipyards in Germany, has ordered type 48/60CR engines for two Global Class cruise ships being built for Genting Hong Kong’s Star Cruises brand.German marine propulsion producer MAN Diesel & Turbo will equip each of the 200,000 gross ton vessels with six engines with a combined output of 96,000 kW.The ocean-going giants, which will operate in China and all over Asia, are scheduled for delivery in 2020 and 2021.Genting Hong Kong recently launched its new cruise line brand Dream Cruises with two 150,000 gross ton ships equipped with MAN engines. The first vessel, the Genting Dream, was delivered in mid-October, while the second cruise ship, the World Dream, is set to join its owner in late 2017.“The cruise business is globally experiencing strong growth. This has led to very long lead times of up to ten years for new large cruise ships, since only few shipyards are specialized in the very challenging construction process of cruise ships.
